Background

The Local Government Act 1999 provides direction to Councils with respect to their management of By-Laws. The following Council By-Laws expire on 31 December 2023.

  • By-Law No 1 – Permits & Penalties
    Provides a permit system for the Council’s by-law suite.
  • By-Law No 2 – Moveable Signs
    Sets standards for moveable signs on roads, including conditions and placement of signs, to protect public safety and protect/enhance amenity of the area.
  • By-Law No 3 – Roads
    For the management of public roads.
  • By-Law No 4 – Local Government Land
    For the management and regulation of

Background

  • By-Law No 1 – Permits & Penalties
    Provides a permit system for the Council’s by-law suite.
  • By-Law No 2 – Moveable Signs
    Sets standards for moveable signs on roads, including conditions and placement of signs, to protect public safety and protect/enhance amenity of the area.
  • By-Law No 3 – Roads
    For the management of public roads.
  • By-Law No 4 – Local Government Land
    For the management and regulation of Council land including prohibition and regulation of particular activities.
  • By-Law No 5 – Dogs
    For the management and control of dogs within the Council area.

Council has endorsed revised By-Laws for public consultation. As required by legislation, the Dog and Cat Management Board has reviewed proposed By-Law No 5 – Dogs and endorsed the document.

Council now invites the Community to provide feedback on the proposed documents.

What’s being proposed?

Changes made across the By-Law suite

  • Council’s By-Laws are only reviewed every 7 years. The documents have been updated for legislative change and to meet the Parliament’s expectations. References to ‘he or she’ have been removed and replaced with gender neutral language.
  • References to election signs have been simplified to improve compliance arrangements for candidates.

Changes to specific By-Laws

By-Law No 1 – Permits & Penalties

  • This By-Law has been rewritten to bring it into line with current legislative requirements.
  • New clauses have been added to clarify management of vehicle offence liability and evidence arrangements.

By-Law No 2 – Moveable Signs

  • Clauses have been reviewed to provide clarity regarding placement of signs for elections, referendums, real estate viewings and charitable events.

By-Law No 3 – Roads

  • ‘Bridge Jumping’ and ‘Fishing’ have been added to the prohibited section (providing consistency with the requirements in the Local Government Land By-Law).
  • The ‘Camping’ clause has been expanded to clarify enforcement arrangements.
  • A new clause has been added in relation to ‘Driving on Formed Surface’ to manage driving on land that is not a formed roadway without permission.

By-Law No 4 – Local Government Land

  • The gender/age specific clause related to ‘Toilets’ has been removed in line with Parliament’s expectations. Regulation of facility usage will be managed principally through attendance by SA Police.
  • New clauses have been added to the Permissions section for ‘Alteration to Local Government land’, ‘Buildings & Structures’, ‘Fishing’, ‘Lighting’, ‘No Liquor’ and ‘Removing Material’.
  • ‘Fires’ and ‘Bee Keeping’ have been moved from Prohibited to the Permission section to enable greater capacity for Staff to permit these activities to occur where appropriate.
  • ‘Swimming’ has been moved from the Permission to Prohibited section.
  • New clauses have been added to the Prohibited – ‘Annoyances’, ‘Children’s Playgrounds’ and ‘Wheeled Recreational Devices’.
  • Clarity has been provided in relation to requirements associated with drone usage (now included in the Permissions section in ‘Model Aircraft and Cars’).

By-Law No 5 – Dogs

  • The Definitions section has been updated for legislation and expanded to improve capacity for Authorised Officers to manage this service.

In particular the ‘Children’s Playground’ definition has been amended so that the protected area around a children’s playgrounds is 5 metres from the nearest piece of equipment where a playground isn’t fenced (increased from 3 metres in the existing by-law).
